Terms and Conditions
The terms that govern your use of fractionalcx.ai. They cover our content, the illustrative nature of the sample material on this site, and the fact that reading it does not create an advisory relationship — that takes a signed agreement.
01Acceptance of these terms
BY PROCEEDING BEYOND THE HOME PAGE, OR BY USING ANY PART OF THIS SITE, YOU EXPRESS YOUR CONSENT TO, AGREEMENT WITH, AND UNDERSTANDING OF THESE TERMS.
FractionalCX.ai LLC, trading as fractional/cx.ai (“f/cx.ai”, “we”, “us”), is pleased to offer you access to this website (the “Site”) and to the material we publish on it, subject to these Terms and Conditions of Use (the “Terms”).
These Terms apply to everyone who uses the Site, including anyone who sends us material through it. If you do not agree with them, please do not use the Site.
02What this site is
The Site describes what we do as a customer experience design agency: our service offerings, the ways we engage, our published thinking, and illustrative examples of the work we produce. It is a description of an agency and an invitation to have a conversation.
It is not a software product, it is not a subscription service, and it does not host a user community, a forum, or an account system. Nothing on it is a binding offer of services. The terms of any actual engagement are set out in a separate written agreement and statement of work, and those documents govern the engagement.
03Changes to these terms and to the site
We may, at our sole discretion, modify, restrict, change, or otherwise alter these Terms or the Site, in whole or in part, impose limits on certain features, or restrict access to part or all of the Site. By continuing to access and use the Site you evidence your consent to, agreement with, and understanding of those changes. Please review these Terms regularly, as they may be modified from time to time without notice to you.
04Our content and intellectual property
The copyright and other property rights in the Site are owned by FractionalCX.ai LLC. All rights in the content we post to the Site are reserved. The content may not be reproduced, republished, or otherwise disseminated without our prior written consent, except that you may download and share whitepapers, articles, and other materials we publish for that purpose, provided you keep them intact and attributed.
fractional/cx.ai, f/cx.ai, the f/cx mark and our logo are our trademarks. Any other names, marks, or logos appearing on the Site belong to their respective owners and are used for identification only; their appearance does not imply any endorsement of, or affiliation with, f/cx.ai.
The f/cx.ai ToolKit (including its modules, frameworks, templates and online tools) and AmorphiaUI AI are proprietary software and intellectual property built and owned by FractionalCX.ai LLC. Use of them in an engagement does not transfer any ownership of them.
The Site may contain text, images, diagrams, audiovisual material, opinions, statements, facts, articles, and other information created by us or by third parties for us. That content is for your reference only and should not be relied upon by you for any purpose. We are not responsible for its continued accuracy.
05Illustrative material, samples and composites
This is the most important thing to understand about the material on this Site, so it is stated plainly and in its own section.
SAMPLE DELIVERABLES, WORKED EXAMPLES, PROJECT PLANS, DIAGRAMS, DASHBOARDS, TRANSCRIPTS, QUOTATIONS, SCORECARDS AND FIGURES SHOWN ON THIS SITE ARE ILLUSTRATIVE COMPOSITES. THEY ARE NOT THE WORK PRODUCT OF ANY CLIENT, THEY DO NOT DEPICT ANY REAL ORGANIZATION OR INDIVIDUAL, AND EVERY FIGURE IS REPRESENTATIVE RATHER THAN REPORTED.
- Composites are constructed from patterns we see recur across engagements. They are designed to show the shape and standard of the work, not to report any client's results.
- Named people, organizations, claim references, quotations, dates and monetary amounts appearing in sample documents are invented for illustration.
- Sample project plans, durations, effort figures and staffing allocations describe a typical shape. Real engagements are rebuilt around your calendar, your people, and what is already in flight, and their scope, duration and cost will differ.
- Outcome figures in illustrative material are not a forecast, a guarantee, or a representation of what your organization would achieve.
Where an outcome, benefit, or performance figure appears anywhere on the Site, treat it as an illustration of a method rather than as a promise of a result.
06No professional advice and no engagement relationship
The content of this Site is provided for general information. It does not constitute professional, legal, regulatory, financial, accounting, technical, or business advice, and it is not a substitute for advice from a qualified professional who understands your specific circumstances.
Reading this Site, downloading a resource, or contacting us does not create an advisory, consulting, fiduciary, or other professional relationship between you and FractionalCX.ai LLC. A relationship of that kind is created only by a signed written agreement between us.
Nothing here is legal, privacy, or regulatory advice. Where our published material touches on data protection, AI governance, fairness testing, disclosure, or similar matters, it describes design practice. Your own counsel and your own regulators decide what applies to you.
07Forward-looking statements
Some of the information on this Site may contain projections or other statements about future events, future capability, or expected outcomes. These are forward-looking statements. They reflect our current views and are identified by terms and phrases such as “intend”, “goal”, “estimate”, “expect”, “project”, “plan”, “anticipate”, “should”, “designed to”, “believe”, “outlook”, and similar expressions.
Do not place undue reliance on forward-looking statements. They speak only as of the date they were made, and we undertake no duty to update them to reflect developments or information obtained afterwards. Actual results may differ significantly. Factors that might cause a difference include, but are not limited to:
- General economic, political and competitive conditions in the markets where our clients operate
- The pace and direction of change in artificial intelligence capability, cost, and availability
- Changes in the regulatory framework governing artificial intelligence, data protection, and the industries our clients work in
- The readiness of an organization's data, knowledge, systems, and governance — which is engagement-specific and frequently decisive
- Decisions taken by an organization about staffing, funding, and sequencing, which are outside our control
- Natural and man-made events beyond the reasonable control of either party
08External links
We may provide links to other websites as a convenience to users of the Site. We are not responsible for the content of those websites, and we do not endorse, warrant, or guarantee the products or services described or offered on them.
09Material you send us
You may send us material through the Site or by email — a message, a question, a document, feedback on something we published (collectively, “Submissions”). The following applies to anything you send:
If you send it, you are responsible for it
- You confirm you have the right to send it, and that sending it does not breach any obligation you owe to anyone else.
- You must respect the law, including the law governing copyright and fair use. Do not send material you do not own or have permission to share.
- Do not send material that is abusive, obscene, offensive, unlawful, or that infringes anyone's rights.
Do not send us confidential information through this site
- Our contact form and general inbox are not a secure or confidential channel.
- Do not send confidential, personal, commercially sensitive, or legally privileged material through the Site. If you need to share something of that kind, tell us and we will put a confidentiality agreement and a secure route in place first.
- Be considerate of other people's privacy. Do not identify a third party in what you send us without their permission.
What we may do with it
- We may use a Submission to respond to you and to continue the conversation you started.
- Unsolicited ideas, suggestions, and feedback about our published material may be used by us without restriction, obligation, or compensation. We do not accept unsolicited business proposals or ideas in confidence, and sending one does not create any obligation on our part.
- We may decline to respond to, or may delete, any Submission at our discretion.
- We expressly disclaim liability or responsibility for Submissions, which do not represent our opinions or positions.
10Our confidentiality obligations to clients
Client confidentiality is a condition of the work we do, and it is the reason the illustrative material described in section 5 exists in the form it does.
- We do not publish client names, client documents, client data, or client results without a specific written permission for that specific use.
- We do not use one client's confidential material to produce work for another.
- Where a client's engagement produces something we would like to write about, we either obtain written permission or we build an illustrative composite that identifies nobody.
If you believe any material on this Site identifies you or your organization, tell us at innovate@fractionalcx.ai and we will investigate promptly.
11Acceptable use of the site
You agree not to:
- Use the Site for any unlawful purpose, or in a way that could damage, disable, or impair it
- Attempt to gain unauthorized access to any part of the Site or any connected system
- Scrape, harvest, or systematically extract content from the Site by automated means without our written consent
- Use our content to train a machine-learning model without our written consent
- Reproduce, resell, or commercially exploit any part of the Site without our written consent
- Misrepresent your affiliation with f/cx.ai or with any person or organization
12General disclaimers
ALL CONTENT PROVIDED ON THIS SITE IS PROVIDED “AS IS”, WITH ALL FAULTS, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THOSE OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF ANY INTELLECTUAL OR OTHER PROPRIETARY RIGHTS, OR ARISING FROM A COURSE OF DEALING, USAGE, OR TRADE PRACTICE.
We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, or that the content is accurate, complete, or current.
We do not grant you any express or implied rights or licenses under any intellectual property rights, except as expressly stated in these Terms.
13Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FRACTIONALCX.AI LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY DIRECT OR INDIRECT DAMAGES, INCLUDING WITHOUT LIMITATION LOST PROFITS OR REVENUES, COSTS OF REPLACEMENT SERVICES, LOST SAVINGS, OR LOSS OR DAMAGE TO DATA, ARISING OUT OF THE USE OF OR INABILITY TO USE THE SITE, OR DAMAGES RESULTING FROM THE USE OF OR RELIANCE ON THE CONTENT PRESENTED, OR ANY INCIDENTAL, SPECIAL, OR OTHER ECONOMIC CONSEQUENTIAL DAMAGES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Nothing in these Terms limits any liability that cannot lawfully be limited. This section governs your use of the Site only; liability arising under a signed engagement agreement is governed by that agreement.
14Indemnification
By using the Site you agree to indemnify and hold FractionalCX.ai LLC harmless against any and all third-party claims based upon or arising directly or indirectly from any material you send us, from your use of the Site, or from your breach of these Terms.
15Privacy
We respect your personal privacy and the sensitivity of your organization's information. When you visit the Site we may collect personally identifiable information that you choose to disclose voluntarily, and we automatically collect certain website-use information as you browse.
We may share your personal information with service providers that perform supporting functions for us — hosting, email, analytics, and scheduling. Except as described in our Privacy Policy, we will not share your personal information or website-use information with any party unless required by law.
Our Privacy Policy sets this out in full and forms part of these Terms.
16Our team and their own accounts
Content posted by people who work with f/cx.ai on their own personal or professional accounts is their own and does not necessarily represent the positions, strategies, or opinions of FractionalCX.ai LLC, unless that person has been authorized to speak on our behalf.
Material we publish is provided for informational purposes and is not an endorsement of, or a representation by, any other party.

18Governing law and venue
These Terms and any dispute arising out of them or out of your use of the Site are governed by the laws of the State of California, without regard to its conflict of laws rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in San Francisco, California for any dispute that is not otherwise resolved.
This section governs use of the Site. Any signed engagement agreement between us has its own governing law and dispute resolution provisions, and those govern the engagement.
19General
- Severability — if any provision of these Terms is held unenforceable, the remaining provisions continue in full force.
- No waiver — our failure to enforce any provision is not a waiver of it.
- Entire agreement — these Terms and our Privacy Policy are the entire agreement between us regarding your use of the Site, and supersede any prior understanding about it. They do not supersede a signed engagement agreement.
- Assignment — you may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
